Under G.L. c. 94C s. 32E, trafficking means knowingly or intentionally manufacturing, distributing, dispensing, cultivating, or possessing with intent to distribute a controlled substance at or above a statutory weight threshold. The critical word is weight. You don’t need to have completed a sale or been caught in a transaction. Once the quantity of drugs seized meets the threshold for that substance, the trafficking charge may be triggered.

This distinction matters enormously. A defendant who claims personal use can’t overcome a trafficking charge on that basis alone if the weight of the seized substance crosses the statutory line. Massachusetts courts have consistently held that weight is the determinative factor. In cases involving shared residences, the defense must establish what portion of the seized drugs actually belonged to a particular defendant rather than to others with access to the same space.

Cocaine and Class B Substances

At 18 to 36 grams, a conviction can result in a mandatory minimum of 2 years and up to 15 years in state prison. From 36 to 100 grams, a conviction can result in a mandatory minimum of 3.5 years and up to 20 years. From 100 to 200 grams, a conviction can result in a mandatory minimum of 8 years. At 200 grams or more, a conviction can result in a mandatory minimum of 12 years and up to 20 years.

Heroin and Class A Substances

At 18 to 36 grams, a conviction can result in a mandatory minimum of 3.5 years and up to 30 years in state prison. From 36 to 100 grams, a conviction can result in a mandatory minimum of 5 years. From 100 to 200 grams, a conviction can result in a mandatory minimum of 8 years. At 200 grams or more, a conviction can result in a mandatory minimum of 12 years and up to 30 years.

Fentanyl

Trafficking 10 grams or more of fentanyl can result in a mandatory minimum of 3.5 years and up to 20 years in state prison.

Carfentanil

Trafficking any amount of carfentanil with specific knowledge that the mixture contained carfentanil can result in a mandatory minimum of 3.5 years and up to 20 years in state prison.

How a Drug Trafficking Case Moves Through the Courts
